1. General Provisions

Welcome to SynapsePlay (hereinafter referred to as "the Platform" or "we"). These Terms of Service (hereinafter referred to as "the Terms") constitute a legally binding agreement between you and the Platform. Please carefully read and fully understand all the contents of these Terms before registering an account or using any of our services.

By registering an account, accessing, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please immediately stop using our services.

2. Service Description

2.1 Service Content. SynapsePlay provides various internet proxy services, including but not limited to Static Residential Proxies (IPv4/IPv6), ISP Residential Proxies, Rotating Residential Proxies, Rotating Mobile Proxies, and Shared Proxies. The specific service content is subject to what is actually provided on the Platform.

2.2 Service Availability. We strive to provide 99.9% service uptime, but do not make absolute guarantees regarding uninterrupted or error-free service. We reserve the right to perform maintenance, updates, or modifications to the service without prior notice.

2.3 Service Changes. We reserve the right to modify, suspend, or terminate part or all of our services at any time. For significant changes, we will make reasonable efforts to notify users in advance.

2.4 Third-Party Dependencies. Some of our services rely on infrastructure and network resources provided by third-party suppliers. We will actively coordinate to resolve service interruptions or quality degradation caused by third-party issues but do not assume direct compensation liability.

3. Account Management

3.1 Registration Eligibility. You must be at least 18 years old (or the age of majority in your jurisdiction) to register and use our services. You must provide true, accurate, and complete information during registration.

3.2 Account Security. You are responsible for maintaining the security of your account credentials. You must not transfer, lend, or share your account with others. You bear full responsibility for any loss or damage resulting from failure to properly safeguard your account information.

3.3 Account Activity. You are fully responsible for all activities conducted through your account, whether or not authorized by you. Please notify us immediately if you discover any unauthorized use of your account.

3.4 Account Termination. We reserve the right to suspend or terminate your account in the following circumstances: violation of any provision of these Terms, engagement in fraudulent or illegal activities, prolonged account inactivity (exceeding 12 months), or failure to pay due fees.

4. Prohibited Uses

Important: Violation of any of the following prohibited terms will result in immediate termination of service without refund. Serious violations may be reported to relevant law enforcement agencies.

4.1 Illegal and Criminal Activities

The use of our services for the following illegal and criminal activities is strictly prohibited:

  • Any form of cyber fraud, phishing attacks, or social engineering attacks
  • Identity theft, identity forgery, or impersonation of others
  • Money laundering, terrorism financing, or other financial crimes
  • Distribution, storage, or access to child sexual abuse material (CSAM)
  • Trafficking of drugs, weapons, or other prohibited items
  • Human trafficking or any form of exploitation
  • Intellectual property infringement (including but not limited to pirated software distribution, unauthorized content reproduction)
  • Any activity that violates the laws and regulations of your region or the region where the proxy server is located

4.2 Network Attacks and Abuse

The following network attacks and abuse are strictly prohibited:

  • Distributed Denial of Service (DDoS) attacks or any form of denial of service attacks
  • Port scanning, vulnerability scanning, or unauthorized network probing
  • Sending spam emails, spam messages, or making harassing phone calls
  • Unauthorized access, intrusion, or attempted intrusion into others' computer systems or networks
  • Distribution of malware, viruses, trojans, worms, or other harmful programs
  • Using proxy services for brute force attacks, password guessing, or credential stuffing attacks
  • Making automated requests to target websites or services beyond reasonable limits (must comply with target website's robots.txt and terms of service)

4.3 Rights Infringement

The following acts that infringe on others' rights are prohibited:

  • Infringing on others' privacy rights, including collecting, storing, or distributing others' personal information without consent
  • Infringing on others' intellectual property rights, including copyrights, trademarks, and patents
  • Publishing defamatory, insulting, harassing, or threatening content
  • Publishing or distributing hate speech, discriminatory content, or content inciting violence
  • Unauthorized use of others' trade secrets or confidential information

4.4 Service Abuse

The following abuses of our services are prohibited:

  • Reselling, redistributing, or providing proxy services to unauthorized third parties in any form
  • Reverse engineering, decompiling, or disassembling our services
  • Attempting to circumvent our usage limits, quotas, or security measures
  • Using automated tools to create accounts in bulk or abuse promotional activities
  • Deliberately consuming excessive bandwidth or system resources to affect other users' normal usage
  • Using our services for competitive intelligence gathering (targeting our platform itself)
  • Mapping, enumerating, or systematically probing our IP address pool

4.5 Region-Specific Compliance Requirements

Given that some users come from Asian regions and mainland China, the following additional restrictions apply:

4.5.1 Mainland China Users. Users must comply with the Cybersecurity Law, Data Security Law, Personal Information Protection Law, and other laws and regulations of the People's Republic of China. Using services for activities that violate mainland Chinese laws is prohibited, including but not limited to illegal cross-border data transmission and circumventing network censorship to spread illegal information.

4.5.2 Japanese Users. Users must comply with the Unfair Competition Prevention Act, the Act on Protection of Personal Information (APPI), and other laws. Using proxy services for web crawling or data collection activities that violate Japanese law is prohibited.

4.5.3 Korean Users. Users must comply with the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Personal Information Protection Act (PIPA), and other laws. Using proxy services to circumvent access restrictions on Korean websites or conduct unauthorized data collection is prohibited.

4.5.4 Southeast Asian Users. Users must comply with the cybersecurity and data protection laws of their respective countries, including but not limited to Singapore's Personal Data Protection Act (PDPA), Thailand's Personal Data Protection Act (PDPA), and Vietnam's Cybersecurity Law.

5. User Responsibilities and Obligations

5.1 Lawful Use Obligation

Users are obligated to ensure that their use of our services fully complies with all applicable laws and regulations, including those of the user's region, the proxy server's region, and the target website's region. Users should understand and comply with relevant legal requirements on their own. All legal liabilities and consequences arising from unlawful use of services shall be borne by the user.

5.2 Security Responsibility

Users are responsible for ensuring the security of their devices and network environment to prevent unauthorized third-party use of their accounts. Users should use strong passwords and change them regularly, avoid using services on public or insecure networks, keep operating systems and software updated, and notify us immediately upon discovering account anomalies.

5.3 Cooperation Obligation

Users should cooperate with our identity verification and security checks, and provide necessary information or documents upon our reasonable request. If we have reasonable grounds to suspect that a user's usage violates these Terms or applicable laws, the user should cooperate with our investigation.

5.4 Indemnification

Users agree to indemnify and hold harmless the Platform from any losses, damages, fines, or expenses (including reasonable attorney fees) incurred by the Platform as a result of the user's violation of these Terms or applicable laws.

6. Payment and Refunds

6.1 Pricing. Service prices are based on the real-time prices displayed on the Platform. We reserve the right to adjust prices at any time, but price adjustments do not affect orders that have already been paid.

6.2 Payment Methods. We support multiple payment methods, including VISA, Mastercard, Alipay, and cryptocurrency (via CoinGate, NOWPayments). The specific supported payment methods are subject to what is actually displayed on the Platform.

6.3 Refund Policy. Proxy services are non-refundable once activated. For services that have not been activated, you may request a refund within 24 hours of purchase. For service failures caused by Platform issues, we will provide compensation or refunds based on the actual circumstances.

6.4 Balance. Balance recharged to your account is non-withdrawable and can only be used to purchase Platform services. Remaining balance will not be refunded after account cancellation.

7. Intellectual Property

All content on the Platform, including but not limited to website design, text, graphics, logos, icons, software, source code, and databases, is protected by intellectual property laws and owned by SynapsePlay or its licensors. Without our prior written consent, you may not copy, modify, distribute, display, transmit, or otherwise use any content on the Platform.

8. Disclaimers

8.1 Service Provided "As Is." Our services are provided on an "as is" and "as available" basis, without any express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Third-Party Actions. We are not responsible for the content, security, or availability of third-party websites or services accessed through our services.

8.3 Limitation of Liability. To the maximum extent permitted by applicable law, SynapsePlay and its affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the services. Our total liability shall not exceed the total amount you paid to us in the 12 months preceding the dispute.

9. Dispute Resolution

9.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of China.

9.2 Dispute Resolution Method. Any dispute arising from or related to these Terms shall first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to the Hong Kong International Arbitration Centre (HKIAC) for arbitration under its then-effective arbitration rules. The place of arbitration shall be Hong Kong, and the language of arbitration shall be Chinese or English.

9.3 Class Action Waiver. To the extent permitted by applicable law, you agree to waive the right to participate in any class action or class arbitration.

10. Modification of Terms

We reserve the right to modify these Terms at any time. Modified Terms will be published on our website with the effective date noted. For significant modifications, we will notify you through website announcements, email, or in-app messages. Your continued use of our services after modifications constitutes acceptance of the modified Terms.

11. General Provisions

11.1 Entire Agreement. These Terms (together with the Privacy Policy and other policies published on the Platform) constitute the entire agreement between you and us regarding the use of services, superseding all prior oral or written agreements.

11.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall remain in effect.

11.3 Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

11.4 Assignment. You may not assign any rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations under these Terms.

11.5 Force Majeure. We shall not be liable for failure to perform our obligations under these Terms due to force majeure events, including but not limited to natural disasters, war, terrorism, government actions, cyberattacks, and power failures.
